7. Liability & Own Responsibility
-
Liability: Skiguru-Zillertal is not liable for slight negligence. This does not affect liability for personal injury or breach of essential contractual duties; in the latter case, liability is limited to the foreseeable, typical damage.
-
Alpine residual risk: Activities in alpine terrain involve inherent risks (weather, snow, avalanches, terrain). These remain within the participant’s risk sphere. We recommend suitable leisure/rescue cost insurance.
-
Protective gear/helmet: Helmet strongly recommended; mandatory for minors. Lack of protective gear may lead to exclusion. Not wearing a helmet may be considered contributory negligence. Additional safety gear as required must be provided by the participant.
-
Damage between/by participants: We are not liable for damage caused by/among participants or third parties unless due to intent or gross negligence by Skiguru-Zillertal or where mandatory statutory liability applies.
-
Appropriate course choice/skills: The participant warrants the chosen course matches their skills and fitness. Bookers for others (esp. minors) confirm suitability for those participants.
-
Rules/indemnity: FIS rules and guide/instructor directions must be observed. Violations may lead to exclusion without refund. The participant indemnifies Skiguru-Zillertal against third-party claims arising from their own breaches to the extent permitted by law.
8. Provider Cancellation/Changes
In cases of force majeure, avalanche risk, bad weather, lift closure, illness/accident of the guide, or insufficient numbers, courses may be cancelled, interrupted, or adapted. Unused services will be refunded or credited; further claims (e.g., travel, lift passes) are excluded.
9. Times, Meeting Point & Punctuality
Meeting point and times are stated in the booking confirmation. Delays shorten the service; no entitlement to extension or (partial) refund.
10. Minors
Participation by minors only with consent of legal guardians; for private instruction, an accompanying person may be required for safety.
11. Insurance
We recommend travel/cancellation insurance and rescue/medical repatriation coverage. Participants are responsible for adequate health and accident insurance.
12. Photo/Audio/Video & Usage Rights
For certain services (e.g., guide & film service, video analysis), photo/audio/video may be produced. Private use of media provided to the participant is permitted.
Use for Skiguru-Zillertal marketing/communications (website, social media, brochures) occurs only with prior, voluntary, documented consent of the person(s) depicted. Consent may be revoked at any time with future effect. For minors, guardian consent is required.
13. Vouchers
Vouchers are transferable, not redeemable for cash; remaining credit stays valid within the voucher period.
14. Data Protection
We process personal data for contract execution according to our Privacy Policy (see website). Contact: info@skiguru-zillertal.at.
15. Governing Law, Place of Performance, Jurisdiction
Austrian law applies. Place of performance is Mayrhofen, unless mandatory consumer law provides otherwise. Consumers benefit from mandatory jurisdictions at their domicile; for businesses, jurisdiction is at our seat.
16. Severability
If any provision is invalid, the remainder remains effective. The statutory provision replaces the invalid one.
Cancellation Policy (Right of Withdrawal)
Leisure services with a fixed date: generally no statutory right of withdrawal.
No Right of Withdrawal for Fixed-Date Services
For contracts relating to leisure activities (e.g., ski instruction, guiding) where a specific date or period is agreed, no statutory right of withdrawal applies. The booking is binding; our cancellation terms (Sec. 6) apply.
Note on Possible Exceptions
-
If a booking is made without a fixed date, a right of withdrawal may exist in individual cases.
-
Regardless, our clear cancellation deadlines (Sec. 6) apply. We recommend taking out cancellation insurance.
Payment Before Course Start (Binding)
The full course fee is due no later than before the course starts — by bank transfer (prepayment) or cashon site. If payment is missing, we may withhold or cancel the service (Sec. 6).
